The fate of suspended High Court judge Joseph Mutava will be known in two weeks when the tribunal investigating his conduct submits the final report to President Uhuru Kenyatta.
After hearing from 25 witnesses, the tribunal’s chair and Court of Appeal judge David Maraga said the team will work round the clock to beat the September 21 deadline.
Speaking after hearing submissions from lead assisting counsel Nazima Malik and lawyer Philip Nyachoti yesterday, Maraga said the date of handing over the report will depend on the President’s diary.
“We are going to do our best and conclude the report within 14 days,” he said during the tribunal’s sitting at Kenyatta International Convention Centre (KICC).
The tribunal is expected to make recommendations to the Head of State on whether the judge is suitable to continue serving based on three complaints leveled against him.
Mutava caused uproar in 2013 when he acquitted controversial businessman Kamlesh Pattni of all charges related to the Goldenberg scandal on grounds that he would not get a fair trial because the case had dragged on for two decades.
Mutava’s lawyer appealed to the tribunal to give his client a fair hearing and not recommend for his removal. “The standard of prove required for the removal of a judge is very high.
None of the evidence submitted warrant removal of the judge from office,” said Nyachoti. The tribunal appointed by the President in May 31 commenced its sittings in February, this year.
