FBI roped into rights lawyer’s death probe

Investigations involving the death of lawyer Willis Kimani, his client Josephat Mwenda and taxi driver Joseph Muiruri will be completed within 14 days, Director of Criminal Investigation Ndegwa Muhoro told the court yesterday.

Muhoro, who had been summoned to court to give assurances that justice will be dispensed in the mysterious murder of the three also told the court that Federal Bureau of Investigation (FBI) has been invited to assist in the probe.

“The Director of Public Prosecutions has also appointed a team of four senior prosecutors to work with various investigative agencies in order to expedite and carry out in-depth investigations,” Muhoro told Justice Lukas Kimaru.

Muhoro said owing to the complex nature of the offence, specialised crime units namely flying squad, homicide, cyber-crime and crime scene units have been deployed to investigate various aspects of the case.

“The investigation team is headed by officer in charge of serious crime SSP John Koki, who is a senior and experienced investigator in complex crimes,” he told the court.

However Law Society of Kenya (LSK) through lawyer Charles Kanjama was not satisfied with the report by Muhoro claiming that it was shoddy and that LSK should be given an opportunity to cross-examine him.

Kanjama argued that the report did not indicate what kind of investigations the detectives were doing and if witness statements had been recorded.

“No steps have been taken to show that the scenes of crime have been secured. We therefore urge this court to allow us to ask some specific questions to Muhoro,” he said.

Justice Luka Kimaru, however, directed that postmortem results done on the three bodies be produced before the court today. He further directed that LSK go through the mobile phone data produced by Safaricom lawyer and see if it captures the information they require.

Meanwhile, trial magistrate Joyce Gandani allowed an application by State Prosecutor Duncan Ondimu to detain another police officer, Leornard Mwangi, for 13 days for police to conclude investigations.

Ondimu told the court that Mwangi was arrested on Monday and the police needed more time to conduct forensic investigations on his phone.
