The tribunal investigating the conduct of retired Supreme Court judge Philip Tunoi will resume tomorrow to make final deliberations. The decision was reached after Tunoi’s lawyer asked for more time to study rulings delivered by Supreme Court judges last week on his retirement.
Lawyer Paul Lelan said they are yet to receive some of the decisions made by the five-judge Bench which upheld the decision of the Appeal Court regarding the retirement of Tunoi and the then Deputy Chief Justice Kalpana Rawal.
The chairman of the tribunal Sharad Rao, however, called on counsel for both the tribunal and Tunoi to incorporate the evidence presented so far in their final submissions. Once we have heard from both sides, he said, the tribunal will compile a final report and make appropriate recommendations.
President Uhuru Kenyatta suspended the judge in February this year and formed a seven-member tribunal to investigate him over accusations that he received Sh200 million bribe in 2014 to rule in favour of Nairobi Governor Evans Kidero in an election petition filed by Kabete MP Ferdinand Waititu. The matter came to light after journalist Geoffrey Kiplagat filed an affidavit.
