The construction of the Sh600 million Mandera-Wargadu Airport commissioned by President Uhuru Kenyatta a week ago has run into a storm after a company alleged not to have qualified in the bidding for the tender moved to court to file a petition to stop the project.
The owners of the aggrieved company are closely associated with a senior Jubilee MP from the North Eastern region, the People Daily has established.
A letter obtained by this newspaper, dated April 11, shows that Alwahab Enterprises Limited Jv, the aggrieved party, had initially been awarded the Sh600 million tender by the Kenya Airports Authority (KAA).
“This is to notify you that a your tender for construction of Mandera-Wargadu Airport (Phase 1) at a sum of Ksh608,553,895.32 has been accepted,” said KAA.
Performance guarantee
The letter further states that the contract would be signed by the parties on the submission of the performance guarantee which should have been within 28 days after the letter was issued. The letter was signed by Yatich Kangugo, the KAA acting managing director.
However, after reviewing the award, the Public Procurement Administrative Review Board (PPARB) overturned the award and instead directed KAA to award it to another company, SEO & Sons, after declaring the first tender unresponsive.
“The decisions of the procuring entity declaring the applicants bid as successful via its letter dated April 11, 2016, be and is hereby set aside and the procuring entity is directed to re-admit the applicant’s tender for technical and financial evaluation,” said PPARB.
According to court documents dated May 25, Alwahab has gone to court to stop the construction and challenge PPARB’s award. The matter will be heard tomorrow.
The ground-breaking ceremony for the airport was among the projects commissioned project by the President during his working tour of the north Eastern region last week.
