Former City Hall chief finance officer Jimmy Kiamba is challenging the dismissal of his suit against fresh demands by the Kenya Revenue Authority’s (KRA) for payment of unpaid taxes.
Kiamba, his wife Tracey Mbinya and Jimbise Limited are aggrieved by the June 19 decision by High Court Judge George Odunga rejecting their application to quash the Sh17million claim by the KRA because they had not exhausted the appellate machinery.
The judge had reasoned that the trio should have first raised objections to the demand and lodged an appeal before the Tax Appeals Tribunal before petitioning the High Court for intervention.
Kiamba had protested that the taxation authorities were abusing the judicial process. However, Justice Odunga said the three petitioners had not provided convincing reasons that the appellate course provided for under the law could not address their grievances.
