The Director of Public Prosecutions Keriako Tobiko intends to challenge a High Court decision blocking the prosecution of Kakamega Governor Wycliffe Oparanya for disobeying summons by the Senate.
The DPP, who had been sued by Oparanya alongside the Director of Criminal Investigations and the Senate, is dissatisfied with the June 29 judgment by Justice George Odunga stopping the politician’s indictment.
Justice Odunga prohibited Tobiko from pursuing the criminal case that was instituted against Oparanya in December 2015 on the basis that the recommendation to arrest and charge the Governor was unlawful.
