Former Kiambaa MP Stanley Munga Githunguri has lost a claim for Sh53 million compensation for trespass on his nine-acre Karen land during the construction of the Southern Bypass nearly four years ago.
The Court of Appeal has ruled that the Sh100,000 in general damages awarded to the politician by High Court Judge David Majanja on March 21, 2014 was reasonable and justifiable.
The Kenya National Highways Authority (Kenha) and the China Roads and Bridge Construction Company had encroached on Githunguri’s land for barely five months before the government acquired it for the road project and fully compensated him, the three-judge bench said.
The National Land Commission (NLC) had gazetted the land for compulsory acquisition on August 23, 2013 and was transferred to the government on January 15, 2014. The road construction has since been completed.
