Everline Kerubo, the woman who appealed against a ruling by the High Court in Kisii to return half of the dowry and fees to her ex-husband, James Mayaka, has lost the case.
The fees was part of the money paid for her education at Narok Teachers Training College ( TTC) by her ex-husband.
Kerubo,through lawyer Wilkins Ochoki, had filed a notice of appeal at the Court of Appeal in Kisumu which was drawn out by judges Daniel Musinga, Gathembu Kairu and Agnes Murgor on April 21.
Last year, Kisii High Court judge Crispin Nagillah ruled that Kerubo pay the dowry and Sh205,000, interest and cost of the petition, prompting, Ochoki to file a notice of appeal against the ruling at the Appellate Court.
The Court of Appeal had granted orders to respondents Kerubo and Charles Moseti to stay the execution and directed them to deposit Sh102,500 in an interest earning account for their advocates.
