Jubilee Party appeals tribunal yesterday declared Charles Njagua Kanyi aka Jaguar the winner of Starehe parlimentary nomination.
The Law Society of Kenya vice-president Faith Waigwa-led tribunal overturned the result by the returning officers that declared incumbent Maina Kamanda winner and directed the National Elections Board to issue Jaguar with the nomination certificate.
“The tribunal overturns the result announced by the returning officer, declaring Kamanda as the winner,”she said. Kamanda failed to rebut the evidence adduced before the tribunal, said the tribunal chair. Jaguar had claimed the votes he garnered in the nominations were altered in favour of Kamanda.
“The complaint showed alteration made to the JP3 and 4 forms after the polling and the said benefited the respondent who was declared the winner,” said the tribunal chair.
Speaking to his supporters outside the party headquarters, Jaguar said justice has been served and even broke down to sing his popular hit Kigeugeu. “They tried to rig me out but justice has been served to the people of Starehe,” he said.
Security remained tight and only journalists and aspirants were allowed access to the building. Meanwhile, Embu Governor Martin Wambora was cleared by the tribunal after dismissing a petition filed by disgruntled Runyenjes MP Cecil Mbarire.
The tribunal dismissed the claim of election irregularities. And yesterday, disgruntled aspirants accused the tribunal of dilly-dallying and urged the team to dispense justice within record time to avert a revolt ahead of today’s deadline for independent candidates to submit party symbols. Waigwa’s appeals tribunal heard the scheduled 52 cases and dismissed 70 of the 107 cases it had heard.
The tribunal said it received 508 appeals. Elsewhere, Nakuru Governor Kinuthia Mbugua has denied claims he plans to ditch Jubilee Party, saying he was waiting for the verdict of the tribunal. He said he had faith in the process. Also, Gatundu South MP Moses Kuria’s win was upheld and Peter Manthi declared winner for Limuru MP seat.
