A fresh bid to have National Lands Commission (NLC) chairperson Muhammad Swazuri removed from office has now started. This is after a petition calling for his ouster was forwarded to a parliamentary committee to commence investigations and recommend to the House whether a tribunal will be constituted to probe him.
A member of the Speaker’s Panel Jessica Mbalu directed the Departmental Committee on Lands chaired by Tharaka MP Alex Muiru to carry out the investigations and table a report in the House in the next 14 days to allow the National Assembly to deliberate on the matter.
In a communication to the House, Mbalu urged the committee to examine the grounds and particulars claimed by the petitioner as the process of removal of persons from office is quasi-judicial, requiring judicious attention and sobriety.
“Pursuant to Standing Order 230, this petition stands committed to the Departmental Committee on Lands. The Committee should guide the House, by a way of a report, on whether the Petition satisfies the requirements of Article 251 of the Constitution and any other relevant laws relating to the grounds for removal of a holder of an independent office.
The Committee has fourteen (14) days within which to submit a report to the House,” he said. Mbalu said her decision came after the Office of the Speaker Justin Muturi received a petition from a Mr Mugo Njeru seeking to have Swazuri removed on grounds that latter used his position to enrich himself as well as defraud his wife of the amount she had been awarded as compensation by NLC.
