State delaying hate speech case, claims Ngunyi

Political analyst Mutahi Ngunyi yesterday accused the prosecution of delaying his hate speech case by failing to produce witnesses.

Through lawyer Wilfred Nderitu, he claimed the prosecution is not taking the case seriously since the prosecutor Moses Omirera, who was appointed by the office of DPP to prosecute the case was absent together with his three witnesses including former LSK director Apollo Mboya.

Mboya was supposed to continue giving his evidence yesterday but was not present in court when the matter was called out by the court clerk.

The prosecution had asked the trial magistrate Martha Mutuku to adjourn the case on grounds that they have not received a report from National Cohesion and Integration Commission(NCIC) before they could proceed.

The accused, however, opposed prosecution application to have the matter adjourned saying that it is the responsibility of the prosecution to prove the case against him and not NCIC, which is also the complainant in the case.

“This being a public interest matter, l reluctantly give the prosecution an adjournment and direct the prosecution to avail all witnesses on February 9 and 10, 2017,” said the magistrate.
