We want to end backlog of cases, says Maraga

Chief Justice David Maraga has rooted for an alternative method of solving cases to ease the current backlog. He said not all cases should be handled by courts but can be heard and be determined by other institutions in the society.

Speaking in Bungoma after opening new law courts, Maraga (pictured) said some minor cases should be determined by provincial administrators or clan elders.

“Cases which can be solved at the village level, let them be heard and be concluded there instead of them being taken to court,” he said. The CJ said the Judiciary was experiencing a shortage of judges and magistrates and if all cases will be determined by courts, then cases will drag for years.

Maraga said the Judiciary is working on ways to enable community elders to handle land-related cases. “We want to sensitise Kenyans on the need of solving land cases at the local level because they have contributed to the backlog of cases at the Land and Environmental courts,’’ he said. The CJ added that they are working on digitising law courts to reduce disappearance of files.
