Two magistrates have refused to hear a case in which four Kenyans and a foreigner are facing charges of trafficking heroin worth Sh22 million, citing state interference.
The accused persons are alleged to have trafficked the contraband in a luxurious yacht that was destroyed by the Kenya Defense Forces (KDF) following orders by President Uhuru Kenyatta.
Chief magistrate Teresia Matheka declined to hear the matter, after it was transferred to her court by chief magistrate Julius Nangea. Nangea withdrew from the case two weeks ago, after he accused the state of sanctioning destruction of the yacht on August 14 last year hence destroying key exhibits.
However, magistrate Matheka ordered that the case be returned to Nangea saying the former had not given sufficient reasons for declining to hear the matter.
“Reasons given for declining the matter are not satisfactory, hence I am transferring the case to the same magistrate,” said Matheka.
