The Court of Appeal will this month rule on whether to allow construction of the Standard Gauge Railway (SGR) on a 91-acre land in Miritini to continue after it was stopped by the High Court following a case filed by two private companies demanding Sh1.4 billion compensation.

This is after it emerged that the government has not deposited Sh2 billion in an escrow account to allow construction of the Sh327 billion rail to continue on a section of land in Miritini after the a Mombasa court issued orders stopping the project.

Milton Makhandia, Kathurima M’noti and William Ouko set November 25 as the date for the ruling following submission by lawyer Eric Busieka representing two companies; Miritini Free Port and African Gas and Oil Company Ltd and Lawyer Cecil Miller representing Kenya Railway Corporation and Ndegwa Wamuti for China Road and Bridge Corporation (CRBC).
