Law gives CAJ power to handle access to information complaints

The Commission on Administrative Justice (CAJ) is now better placed to play oversight and enforcement roles in handling complaints related to access to information.

The new law which gives effect to Article 35 of the Constitution now enables Kenyans to seek help in case they face difficulties in accessing some information and obligations from public and private entities.

Access to Information Act 2016 facilitates access to information held by the institutions, publication of information held by them and publication of information of any contract entered into and policies affecting the public.

The Otiende Amollo led-commission is therefore expected to play the role of handling complaints relating to access to information, consideration of reports from public bodies on implementation of the Act and monitoring the country’s implementation of international obligations relating to access to information, among others.

According to a statement from the Ombudsman’s office, the first complaint has been filed by Gravel Mwambala, against the leading mobile provider (Safaricom) for failing to provide him with data pertaining to his registered mobile phone number.
