Gatundu South MP Moses Kuria and his Kabete counterpart Ferdinand Waitituyesterday accused the prosecution of delaying an incitement to violence case against them.
When the case came up for hearing before magistrate Charity Oluoch, the legislators, who are accused of threatening the life of opposition leader Raila Odinga, said the prosecution is delaying the case by failing to produce witnesses in court.
Through their lawyers, they also accused the prosecution of failing to supply them with copies of witness statements and other documentary evidence which will be used in the trial.
“The accused have a right to fair trial and to be supplied with all evidence material in order to prepare their defence before trial,” said lawyer Harrison Kinyanjui.
State counsel Dancun Ondimu undertook to supply the statements before the next hearing date. Kuria and Waititu have denied the charges and are out on a Sh5 million bond.
