A casual labourer who suffered life-threatening injuries while working at a construction site in Kisumu has been awarded Sh6.5 million compensation.
Alex Otieno, 56, was preparing slab shutters on November 29, 2013, when a concrete mixer sprayed him with the liquid mixture and felled him from the second floor of the building that was under construction by Hayer Bashan Singh and Sons.
He sustained serious injuries that rendered him a complete paraplegic with full paralysis. High Court judge David Majanja noted in his judgment that Otieno and his employer had settled the issue of liability.
He had sued the firm along with his wife Hellen Akinyi, who recounted to the court the suffering her husband underwent. In an interesting twist, Justice Majanja awarded Akinyi Sh100,000 in damages on the basis that the spouse of an injured person is entitled to compensation for impairment resulting in curtailment of conjugal rights and the associated physical and emotional effects.
